How long does the process take?

Once all required documentation is submitted a decision is typically completed within 30 days. Common reasons decisions may be delayed include low offers for your property which are under fair market value and junior liens held by other banks or individuals that also need to agree to a short sale. Depending on the type of loan, an investor and/or insurer may also need to approve the sale.

Will I have any tax liabilities?

Consult your tax advisor to see if you will incur any tax liabilities as a result of the short sale.

How will a Short Sale affect my credit?

The completion of a Short Sale may affect your credit rating. The final disposition of a completed Short Sale may be reported as "Account paid in full for less than the full balance" on your credit report.

Does Chase charge a fee for the completion of a Short Sale?

No, Chase does not charge a fee for processing or completing a Short Sale.

I signed up with a Short Sale negotiation service. Will Chase pay their fee?

No, Chase will not pay any 3rd party Short Sale negotiation or processing fee nor allow this type of fee to be deducted from the proceeds of the sale of the property.

Will I be required to pay back the amount of the shortage or the deficiency balance?

The approval letter will specify the terms of the Short Sale approval. Your Loss Mitigation specialist will be able to explain whether the deficiency balance will still be owed.

My loan is in Foreclosure. Can I still be considered for a Short Sale?

Yes, however the Foreclosure may continue during the process. Please contact your Loss Mitigation specialist for more information.

My loan is current. Can I still be considered for a Short Sale?

Yes, however the required financial documentation must be submitted along with a detailed Hardship letter explaining the inability to continue to maintain your loan payments.

I have two loans. Can I still be considered for a Short Sale?

Yes, however if the 2nd loan is with another bank they will need to approve the Short Sale separately.

My property is a rental. Can I still be considered for a Short Sale?

Yes, however you must include rental income documentation, which will include bank statements, rental agreements or an explanation letter if rents are not being generated.

Do property taxes need to be paid during the Short Sale process?

Yes, if your property taxes are not escrowed as part of your loan payment and they become due they should be paid.

I filed Bankruptcy. Can I still be considered for a Short Sale?

Yes, however consult your Bankruptcy attorney regarding the process of selling your property during a Bankruptcy.

I want to deed my property to Chase. I have heard this is possible through a Deed in Lieu of Foreclosure. Is this an option?

Buying your first home can be a difficult process - especially if you don't ask the right questions ahead of time. According to Kimberly Palmer, key contributor to U.S. News & World Report, a critical mistake first-time buyers in Nevada make is overlooking hidden costs that could have been revealed prior to making a purchase decision. Determining these and other critical factors can have a huge impact on your ability to find the right Las Vegas property for your needs.



When it comes to purchasing your first home, buyers need to remember that their realtor is there to help ease the process and should take advantage of each opportunity to learn from them. Similar to a lawyer or any other consultant, a realtor is your advocate and counsel for the duration of the home buying life cycle, from the home search to close of escrow.

At a minimum, these are some of the most common questions to ask a realtor when buying your first home:
1) Is the listing price in line with market value?
2) What is a fair offer on the property based on recent comparables?
3) How long has the property been on the market?
4) How motivated is the seller?
5) What price did the seller pay for the home?
6) What is the age and condition of the property?
7) How many people have owned the property?
8) What items are included in the sale (e.g. appliances, window coverings, etc.)?
9) What are the annual taxes?
10) Is there a monthly or quarterly HOA?
11) Is the current owner up-to-date on payments?
12) How quickly can the property close?
13) Has all work on the house been completed with permit and to code?
14) What schools is the property zoned for?
15) Is there much crime in the neighborhood?
16) What type of utilities does the home require (e.g. oil, gas, septic, etc.)?
17) Who do you recommend to perform the home inspection, and why?
18) Which title company do you recommend, and why?
19) What is your relationship with the listing agent?
20) Do I need to be pre-qualified to write an offer?

And most importantly:
21) Is there anything you need to tell me that I haven't already asked?

Although a list of 21 questions may seem like overkill, when it comes to buying your first home, you can never be too informed. Realtors are people too and, regardless of how celebrated or highly recommended they are, they can forget to mention important details as easily as any other. The property on El Presidio was in default and the homeowner was facing Foreclosure in Nevada. After many negotiations with the bank with no solutions, the home owners contacted The Ballen Group to negotiate a Las Vegas short sale on their behalf. The process was not easy, but with the strong negotiating powers, problem solving and a comprehensive marketing process, Ballen achieved the difficult approval to close the home. As with all Las Vegas short sale approvals, there must be a ready & willing buyer to purchase the home at what the bank considers “fair market value” based on their appraisers values. The seller opted to short sale their home rather than allow a Las Vegas Foreclosure in hopes of having a better credit score and the ability to purchase Las Vegas Real Estate again in approximately 2 years. The great news here is that the entire NevadaShort sale Process only took a total of 48 days to close - Start to Finish.

The specific Short Sale Facts in this case are as follows. There was one Lien Holder – Wachovia. The Original List price was $249,900. The Sales Price was $249,900 with $7,430 in closing costs with a conventional loan. The deficiency was waived AND the seller received $3000 cash back. The first offer accepted was by the buyer who purchased the property. It took a total of 37 days to approve and 48 days total from list date to close date.

Sometimes, to avoid going through the costs of foreclosure, a bank will sanction a short sale by allowing a Buyer to purchase the home for less than the mortgage balance while the home is in pre-foreclosure stage. Pre-foreclosure state is the first of the three stages of foreclosures. NevadaHomeowners, who have either a Wachovia, World Savings or Golden West loan that is in danger ofNevada foreclosure, can be a candidate for the FAST TRACK Wachovia Short Sale Program inNevada. The new FAST TRACK program is quick and easy! First, we will place your home on theNevada Real Estate market with the proper exposure to place you in the best Nevada Short selling position. Next, we will put you in touch with the local Short Sale Manager assigned to your local area.

Benefits:
Delinquency not required. Verbal income and asset verification. No Deficiency liability against seller upon approval. Foreclosure process MAY BE STOPPED with valid buyer offer. Borrower can receive $2,500 for relocation assistance. Wachovia will also evaluate you for participation in the HAFA program. HAFA is the new set of short sale guidelines put out by Treasury Department which speeds up the short sale processing for certain types of loans- only applies to primary residences and homes which are not owned or guaranteed by FHA, Fannie Mae, Freddie Mac or VA.

Many are closing in 45 days or less with approval. (Loan must be a “proprietary loan”. Wachovia is the note holder not purely the servicer of your loan)

What is a Las Vegas Short Sale?
A Las Vegas Short Sale occurs anytime the value of the property is less than the amount owed to the lender and the lender agrees to write off the difference. In other words, the homeowner is "upside down" on his loan. Short sales may be forced by a variety of situations: job loss, loss of income, divorce, medical bills, or changing payments on adjustable rate mortgages (ARMs). 

Why would a lender agree to a Las Vegas short sale? Lenders make their own business judgments when accepting or rejecting short sales. Lenders are in the business of making and servicing loans, not taking properties back through foreclosure and reselling them. They want to avoid spending time and money to foreclose, evict borrowers, and resell properties. They want to avoid paying property taxes, insurance, maintenance and repairs. They want to avoid risking theft and vandalism to the property. Before the mortgage lenders will consider a short sale, they need to know financial information about the seller and why the seller cannot pay the loan. The seller will need to submit information to the lender to assist the lender in deciding whether to accept a short sale.
  • May simply be "Approved" for the sellers hardship - not buyer, financing, or price
  • May simply be "Approved" for particular buyer's financing and offer price
  • May be pre-approved at a certain price (this is not always where the agent LISTS the home)
  • May have been approved months prior at a certain price and now circumstances have changed
  • May be "Approved" by the bank, but Seller still needs to agree to bank terms
